Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the weight management service provided by DayNight Pharmacy ("we", "us", "our") through The Yorkshire Wellness Hub ("Service"). The Yorkshire Wellness Hub is a trading name of DayNight Pharmacy and not a separate legal entity.

By accessing or using this Service, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility and Patient Verification

  • You must be between 18 and 84 years old and meet BMI and health criteria set by our clinicians.

  • You must provide truthful, complete, and accurate medical history and current health status.

  • You must provide valid identification at your initial consultation to verify your identity.

  • You must consent to allow us access to your Summary Care Record (SCR) before any medication can be prescribed or supplied. Failure to provide SCR access or equivalent verified medical records will result in refusal or delay of treatment.

  • Providing false, misleading, or incomplete information may result in refusal of service and liability for any consequences.

3. Service Description

  • The Service includes an in-person initial clinical assessment, medication supply via PGD, and health coaching.

  • Medication supplied includes Wegovy (Semaglutide) and Mounjaro (Tirzepatide).

  • Follow-up appointments may be remote or in person; however, all medication supplies and mandatory monthly reviews are in person.

  • Health coaching is provided as part of the package; medication is not supplied independently.

4. Booking, Payment, and Deposits

  • Booking requires completion of an online health survey if booked through the online portal.

  • Full payment must be made prior to medication supply.

  • Pricing for coaching and medication is subject to change, with current fees provided at booking.

5. Consultations and Medication Supply

  • The initial consultation and first injection must be conducted in person at our pharmacy branch.

  • Follow-ups may be remote but monthly face-to-face reviews are mandatory for progress evaluation and further medication supply.

  • Medication is supplied only in person via pre-filled syringes.

  • You agree to comply with all clinical instructions regarding medication use and reporting of side effects.

6. Patient Responsibilities

  • You must provide complete and accurate health information, including past and current medications.

  • You must attend all scheduled appointments and follow treatment plans.

  • You must report any side effects, adverse reactions, or health changes promptly.

  • If you use a relative or third party as a translator, you accept full responsibility for accurate communication and understanding of information provided.

  • You must not attempt to obtain medication from multiple providers or engage in any form of medication misuse.

  • You must allow access to your SCR or provide equivalent verified medical records. Failure to comply may lead to treatment refusal.

7. Risks, Side Effects, and Medical Disclaimer

  • Medications carry risks and potential side effects, which will be explained during consultation.

  • Individual results may vary and weight loss is not guaranteed.

  • The Service is not a substitute for ongoing medical care by your GP or specialists.

  • We are not liable for adverse effects resulting from incomplete or inaccurate information provided by you.

8. Data Protection and Privacy

  • Your personal and health data will be processed according to applicable data protection laws and our Privacy Policy.

  • Data may be shared with third parties, including PharmaDoctor for PGD purposes.

  • You consent to this processing by using our Service.

9. Limitation of Liability and Acknowledgement of Risk

  • You acknowledge that medications may cause side effects even when prescribed and monitored correctly.

  • DayNight Pharmacy, The Yorkshire Wellness Hub, and associated staff, including locums, provide care in line with professional standards and PGD requirements.

  • You release and indemnify us from any claims arising from side effects or treatment complications except where caused by proven negligence or willful misconduct.

  • Liability for death or personal injury caused by our negligence is not excluded.

10. Intellectual Property

  • All content, branding, and materials provided are the intellectual property of DayNight Pharmacy and The Yorkshire Wellness Hub.

  • Unauthorized use is prohibited.

11. Changes to Terms

  • We may update these Terms at any time.

  • Continued use of the Service after changes constitutes acceptance.

12. Governing Law and Jurisdiction

  • These Terms are governed by English law.

  • Disputes shall be resolved in courts of England and Wales.

13. Acknowledgement

By proceeding, you confirm that you have read, understood, and agree to these Terms, that all information you provide is true, and that you accept full responsibility for your part in your treatment.
